The following terms of use (hereinafter referred to as TERMS OF USE) constitute the agreement between Grupo Aduanero Del Bravo S.A. de C.V. (hereinafter ACTM Dist ) and any user of the SITE whose electronic address is: https://www.actm-dist.com/ (hereinafter the SITE).

The use of the SITE by any person attributes them the quality of user (hereinafter the USER) and this implies their full and unconditional adherence to these TERMS OF USE; consequently, it is essential that the USER reads them beforehand and evaluates them carefully, so that they are aware that they are subject to them and to any modifications that may occur, each time they access the SITE.

If at any time the USER is not in full or partial agreement with these TERMS OF USE, they should immediately refrain from using the SITE in any part or section.

The USER agrees that in various parts of the SITE there may be special stipulations that, as the case may be, will substitute, complement or modify these TERMS OF USE (hereinafter referred to as SPECIAL CONDITIONS), so it is also essential that the USER reads them beforehand in each case and, if they are not in full or partial agreement with them, they should refrain from using the part or section of the SITE regulated under that CONDITION or SPECIAL CONDITIONS. If the USER uses the part of the SITE regulated by one or more SPECIAL CONDITIONS, it will be understood that they are subject to them in full and unconditionally.

Access and use of the site

Access and use of the SITE by ACTM Dist is free for the USERS. The USER will be required to register or subscribe to the SITE only when specifically requested.

Access and use of the site

Through the SITE, ACTM Dist provides USERS with access to diverse information provided by ACTM Dist or by persons linked to this information directly or indirectly (hereinafter referred to as CONTENTS).

The USER recognizes that the use of the SITE does not imply any property right over it, any of its elements or CONTENTS.

ACTM Dist reserves the right to modify at any time and without prior notice the presentation, configuration, information, CONTENTS and, in general, any part or aspect related directly or indirectly to the SITE.

Contents

Obligation to use the SITE and CONTENTS correctly The USER commits to use the SITE and CONTENTS in accordance with the applicable laws, as provided in these TERMS OF USE and with respect to public order. The USER commits to use the SITE and any CONTENT or aspect related to it, in a way that does not infringe the rights or interests ofACTM Dist , of persons linked to it directly or indirectly or of third parties. The USER will use the SITE and/or CONTENTS in a way that does not harm, disable, deteriorate or compromise it in total or in part.

Media for obtaining contents

The USER should refrain from obtaining or attempting to obtain information, messages, graphics, drawings, sound and/or image files, photographs, recordings, software and in general, any type of material accessible through the SITE or CONTENTS.

Use of the SITE and elements found in it can be made using only the established and indicated media or procedures within the SITE.

Correct use of contents

The USER commits to use the CONTENTS and the elements used in the SITE diligently, correctly and lawfully, and in particular, commits to refrain from: (a) using the CONTENTS for purposes or effects contrary to the law, public order and as provided by ACTM Dist for the use of this SITE; (b) copying, distributing, modifying, reproducing, distributing or using the CONTENTS and elements used in the SITE, without express written authorization from ACTM Dist , unless it is for non-commercial purposes; (c) modifying or manipulating the trademarks, logos, commercial notices, commercial names and distinctive signs of ACTM Dist , of the SITE or of persons linked directly or indirectly to ACTM Dist (unless they have express written authorization), (d) suppressing, eluding or modifying the CONTENTS and the elements used in the SITE, as well as the technical protection devices, or any mechanism or procedure established in the SITE.

ACTM Dist declares that all CONTENTS and elements used in the SITE are duly registered and protected under the corresponding authorities and laws in Mexico. The USER commits to respect all intellectual property rights over the CONTENTS and elements used in the SITE of which ACTM Dist is the owner.

Technical Content of Air Purification and Surface Treatment

The technical information on forced air ventilation and climate control provided by ACTM Dist is for general information and should not be used as a substitute for diagnosis and/or advice from qualified professionals. The USER should clarify any technical doubt or ventilation and climate control of industrial and commercial spaces with their responsible professional. ACTM Dist does not assume any responsibility for the risk to your projects that could be caused by the information contained in the SITE. The USER must take into account that the information in the SITE is updated periodically and could not have the most up-to-date ventilation and climate control information. The use of the SITE does not create a relationship between ACTM Dist and the user so ACTM Dist is not obligated to follow up with USERS.

Use of the SITE, CONTENTS and CONTENTS under the exclusive responsibility of the USER

By simply accessing the SITE, the USER recognizes and accepts that the use of the SITE and CONTENTS is under their exclusive and strict responsibility, so ACTM Dist will not be responsible at any time and under any circumstances for any malfunction or problem that may have occurred in the computer (hardware) or computer programs (software) that the USER uses to access or navigate any part of the SITE.

Exclusion of warranties and liability

Exclusion of Warranties and Liability for the functioning of the SITE and CONTENTS, viruses and other harmful elements. ACTM Dist does not control and does not guarantee the absence of viruses in the CONTENTS, nor the absence of other elements in the CONTENTS that could produce alterations in the USER's computer system (software and/or hardware) or in electronic documents and files stored in their computer system.

Sites and contents not belonging to the SITE and to the CONTENTS

As a private company, independent and outside of political and religious partidarism,ACTM Dist does not allow the publication of contents that contravene this character and reserves the right to accept publishing or suggesting sites, subsites or material not belonging to the SITE and to ACTM Dist that it considers of interest for the USERS. In case it does so, ACTM Dist is not responsible in any way for these sites and materials, as well as for the access or use by the USER of the same.

In the same way, any site and/or subsite on the Internet, not belonging to the SITE, may have a link (link, hyperlink, link) to the SITE or CONTENTS with or without authorization from ACTM Dist . Therefore, ACTM Dist is not responsible for the origin, uses and destinations of these links. In the same way, the responsible for the sites and/or subsites that mention or handle a link to the SITE and/or CONTENTS, is not necessarily authorized to handle these links, nor to promote ACTM Dist , the SITE or the CONTENTS. ACTM Dist does not assume any responsibility for these sites, nor for their contents not belonging to the SITE, nor does it accept any charge for advertising, unless there is a previously signed contract between the parties.

Denial and withdrawal of access to the site and/or to the contents

ACTM Dist reserves the right to deny or withdraw access to the SITE and/or CONTENTS at any time and without prior notice, for its own initiative or at the request of any person, to any USER for any reason, including without limitation to those USERS who use the SITE in an improper way, to any part or section of it or to the CONTENTS, or who violate these TERMS OF USE or SPECIAL CONDITIONS that may be applicable.

Duration and termination

The SITE and CONTENTS have indefinite duration. However, ACTM Dist may terminate, suspend or interrupt at any time and without prior notice the SITE and/or any of the CONTENTS.

Obligation to follow instructions

The USER commits to follow the letter any instruction given by ACTM Dist by authorized personnel by ACTM Dist related to the SITE, in reference with any mechanism or procedure established to use the SITE and the CONTENTS. The USER should only follow instructions given by ACTM Dist .

Responsibility for damages and losses The USER is responsible for any damage and/or loss of any nature that may have been caused by not complying with these TERMS OF USE or any applicable regulation, so ACTM Dist absolves itself of any civil, penal, administrative or any other liability.

Without prejudice to the provisions of the preceding paragraph, in the event thatACTM Dist were sanctioned or convicted by competent authority in any procedure related to civil, penal, administrative or any other liability, it would notify the responsible USER, who would have to pay to ACTM Dist the amount that was sentenced to cover, as well as the costs, fees and other expenses incurred, within the 15 natural days following the notification. In case of delay in payment in the indicated term, the USER commits to pay to ACTM Dist by way of conventional penalty, an amount equivalent to the principal amount.

Personal data of character

To use or enjoy some of the CONTENTS it is necessary for the USER to provide beforehand to ACTM Dist certain personal data (hereinafter PERSONAL DATA) thatACTM Dist can manage automatically or not. The USER, when accessing the SITE or any of the CONTENTS where PERSONAL DATA are required, is authorizing ACTM Dist to carry out analyses and studies based on them.

The USER commits to provide true and accurate PERSONAL DATA, and if the USER did not want to provide them in the parts of the SITE that are requested, they should refrain from using that or those parts or sections of the SITE. If the USER provided false or confusing information, ACTM Dist could deny him access to the SITE and the CONTENTS within it, without prejudice to the possibility of requiring indemnifications from the USER.

By providing their PERSONAL DATA in the SITE, the USER is authorizing ACTM Dist to give to any competent authority the relevant information, if it is requested by the appropriate legal means. ACTM Dist will not share any personal information that has been provided, with third parties, unless it is required to provide a service or a product required by the USER.

License

ACTM Dist authorizes the USER to use the SITE exclusively under the TERMS AND CONDITIONS here expressed, without implying that it grants the USER any license or authorization for any type of right distinct from the use mentioned above regarding the Intellectual Property of ACTM Dist . It is understood as Intellectual Property all registered and/or used marks in Mexico or abroad by ACTM Dist , as well as all rights over inventions (patented or not), industrial designs, utility models, confidential information, commercial names, commercial notices, copyright reserves, domain names, as well as all types of patrimonial rights over works and creations protected by copyright and other forms of industrial or intellectual property recognized or that are recognized by the corresponding laws.

Other provisions

Form. The USER accepts that a printed version of these TERMS AND CONDITIONS, and any communication sent and/or received in electronic form will be admissible as probative medium in any judicial or administrative procedure.

Applicable law and jurisdiction. In everything related to the interpretation and compliance of what is provided here, by simply accessing the SITE, the USERS accept to be subject to the applicable laws and to the jurisdiction of the competent courts in Mexico, renouncing any other jurisdiction that by reason of their present or future domiciles or for any other reason could correspond to them.

Ineffective provisions

In case any of the TERMS AND CONDITIONS here expressed is considered unenforceable or declared null or invalid according to the applicable legislation, it will be substituted by a term or condition that is valid and that can comply with greater rigor the objective of the unenforceable provision or that has been declared null or invalid. The other terms and conditions will continue in full force.

Rights

Any right not expressly conferred in this document is understood to be reserved to ACTM Dist .
